Attorney Ally Shields sued her former law firm partners at Morgan & Stearns, for a violation of Title VII of the Civil Rights Act, alleging that she was “forced out” of the partnership because of conduct and attitudes that discriminated against her on the basis of sex.  She also claimed that she was fired from the partnership because she had refused to go along with the cover-up of certain suspect accounting practices by some of the firm’s biggest clients.

Morgan & Stearns filed a timely motion to dismiss for failure to state a claim upon which relief could be granted, based on its argument that Title VII does not cover professional legal partnerships.  Relying on Hishon v. King and Spalding, 467 US 69 (1984), the district court rejected the motion.
